NOTE: This policy is EXTREMELY important and must be followed or risk the temporary if not permanent disabling of your keyword.
The Mobile Marketing Association (MMA) has established mobile compliance regulations designed to protect consumers from unwanted or unexpected charges from texting and unwanted spamming on their phones. Anytime you publish your unique keyword and short code of 55678 (USA) or 70734 (Canada) on marketing literature or other media you need to include the following disclaimer where X Is defined as a specific number of mobile text messages you expect to send to your opt in list per month (we recommend no higher than “4” which would average out to 1 mobile campaign per week).
Please note the words Text HELP for help and Text STOP to cancel are boldfaced which are required to remain in compliance. The font size can be small but must obviously be legible. Substitute “X” with a number such as 1, 2, 3 or 4 based on the number of mobile campaigns your business expects to run on a monthly basis. The line “Consent NOT required for purchase of goods/services” means that your customers can't be forced to consent to receive marketing text messages from your business when they make a purchase at your business.
If your keyword is published anywhere (i.e. cards, print, tv, radio, online, social, email, etc. etc.) you MUST include all the required content as noted above or risk non-compliance with MMA guidelines. Non-compliance can result in unsatisfactory audits which can lead to the permanent disabling of your keyword from the short code.
Furthermore, if you publish your keyword and shortcode online over your website you need to include a link to terms and conditions and a privacy policy as follows:
“Click to review Terms & Conditions / Privacy Policy.”
We recommend incorporating this hyperlink inside your existing Terms and Conditions / Privacy Policy under the header “Mobile Terms of Service”.
If you do NOT have a Terms and Conditions and/or Privacy Policy webpage then at a minimum, you should hyperlink to our generic Mobile Terms of Service at http://mobile.loyalpatron.com/terms_of_use.asp so your MMA compliance content looks like this:
Up to X messages per month. Standard message and data rates may apply. Text HELP for help.
Text STOP to cancel. Consent NOT required for purchase of goods/services. Review Mobile Terms of Service.
